2026 Adult Education Graduation

I understand that I or my child will be photographed and/or recorded in audio and/or visual format for a website, film, book, printed media, or other potential uses (collectively, the "Work") by representatives of the Choctaw Nation of Oklahoma ("Nation"). In exchange for the opportunity to contribute to, and perhaps be depicted in, the Work, I hereby grant to the Nation for myself and/or my child, our assignees, successors, agents and legal representatives, and any other entity that they may authorize, the right to make any and all uses, both private and commercial, of my name, my child's name, our biographies, performances, and our likenesses (collectively, "Likeness") as depicted in the Work or as used in connection with promotion and exploitation of the Work. The Nation will be the owner of all rights to the Work. I further agree that the Nation may modify, adapt and exploit the Work in any way it sees fit in perpetuity. I further grant he Nation a royalty-free, fully-paid, perpetual, irrevocable, unrestricted, unconditional, non-exclusive license to use, reproduce, modify, publish, edit, adapt, create derivative works from, translate, distribute, perform, display and otherwise exploit my Likeness in the Work and all elements thereof alone or as part of other works in any form, media, or technology, whether now known or hereafter developed or discovered, and to license and sub-license such rights through multiple tiers of sub-licenses, all without any notification, compensation or attribution or otherwise to me or my child.

I agree on behalf of myself and/or my child and our successors, assigns and legal representatives to assert no claim of invasion of privacy, appropriation of my right of publicity, violation of copyright, trademark or other proprietary right I may hold in connection with my Likeness as used in the Work. I expressly waive any right to inspect any version of the Work or otherwise approve it. In the event I attempt to enforce any right in connection with my or child's contribution to the work, I agree to indemnify and hold harmless the Nation for its reasonable costs and disbursements associated with such action, including reasonable attorneys' fees.

I understand and acknowledge that this agreement contains all of the agreements and understandings between the Nation and me and/or my child with respect to the matters contained herein, and no prior or contemporaneous oral agreements or written correspondence will affect the provisions of this agreement. I understand and acknowledge that this agreement and the provisions herein will be interpreted in accordance with the laws of the State of Oklahoma without giving effect to its principles of conflicts of laws.

I understand and acknowledge that if any provision of this agreement is declared to be invalid or unenforceable, such invalid or unenforceable provision, will be deemed stricken from this agreement and the enforceability of the remaining provisions of this agreement will not in any way be affected or impaired thereby. I understand and acknowledge that this agreement will bind and inure to the benefit of the Nation and me and our respective successors and assigns.

I am at least 18 years old and I warrant that I am the parent or legal guardian of the child named below and that I have the legal authority to sign this agreement.

I have read this agreement, fully understand its terms, and understand that: (i) I have given up substantial rights by signing it; (ii) I will not be paid any money for giving the Nation this Release, or for signing this Release; (iii) I have signed it freely and without any inducement or assurance of any nature; and (iv) I intend it to be a compete and unconditional release of all liability to the greatest extent allowed by law.
